How can it possibly be moot? The penultimate sentence of section 2.2 of the
policy manual is 

Packages may not depend on packages with lower priority values
(excluding build-time dependencies).

One may not agree with the policy, but it is clear.

(I think the consensus would be that in the presence of "Depends: X|Y",
policy is satisfied so long as one of X or Y not lower, but it might be
better to make that explicit.)
