Actually this sounds just like the Artistic License, which is specifically
called out in the DFSG as being a compliant license. 

While I disagree, the Guide sees the allowance of the copying fee as
sufficient permission for money to change hands.

I don't believe that these types of clauses are disallowed in the DFSG.
