When looking at
http://ftp.dante.de/tex-archive/systems/texlive/tlnet/2008/archive/
there is a compiled binary for TL2008 and it is on the TL2008 DVD. 
Hence I'd guess this bug is "fixed in upstream".  I didn't test if it
even starts up.
